POVL — Terms of Use

1. About these Terms

These Terms of Use ("Terms") are an agreement between you and Barış Altın, an individual developer based in Türkiye who makes and runs POVL ("POVL", "we", "us"). They apply to the POVL app and povl.app. By using POVL you accept these Terms. If you don't accept them, please don't use POVL.

Our Privacy Policy explains how we handle personal data.

Entertainment, not advice

POVL's analyses, archetypes and scores are calculated from the subjective ratings people enter. They are for entertainment and conversation. They are not scientific findings or psychological, medical or professional advice, and you shouldn't base important decisions about anyone on them.

2. Who can use POVL

You must be at least 13 years old to use POVL. If you are under 18, or under the age of majority where you live, you may use POVL only with the permission of a parent or guardian, who accepts these Terms for you. Where the law of your country sets a higher age for using online services without a parent's consent, that age applies.

You may not use POVL if the law prohibits you from doing so.

3. Your account

You can try POVL as a guest. To save your results and use all features, you sign in with Apple or Google.
One account per person. Creating extra accounts to collect free credits or get around a block or suspension is not allowed.
Keep access to your Apple or Google account secure. You are responsible for what happens in your POVL account, and you should tell us at hello@povl.app if you think someone else is using it.
You can delete your account at any time in the app (Profile → Delete My Account). Deletion is immediate and cannot be undone.

4. What POVL is

POVL lets you rate people you know on personality traits and turns those ratings into reports. You can add friends by friend code or invite link and rate each other, answer discovery questions, and compare views. Reports are produced automatically by our own fixed rules, without human review and without third-party AI.

We keep improving POVL, so features, content and limits may change over time. We will not take away a paid feature during a subscription period you have already paid for without offering a fair remedy where the law requires one.

5. Your content and other people

5.1 Your content

What you enter in POVL (names, photos, ratings, answers and the like) remains yours. You give us a worldwide, non-exclusive, royalty-free licence to store, process and display it only as needed to run POVL for you and the people you share it with. The licence ends when you delete the content or your account, except for copies other users already received and backups that expire as described in the Privacy Policy.

5.2 Rating real people

Ratings are your personal, subjective opinions, not facts about the person. You are responsible for what you enter and share.
People you add are private to your account. If you share a report about someone, do it respectfully and never to embarrass, threaten or harm them.
Add only what you need. Don't add sensitive information such as health, sexual life or orientation, religion, political views or criminal records, and don't upload photos you have no right to use.
If someone asks us to remove information about them, we may do so, and we may remove content that we believe harms others.

6. Rules

When using POVL, you must not:

bully, harass, threaten, humiliate or discriminate against anyone, or encourage others to do so;
post sexual, violent, hateful or illegal content, or any content involving the sexual exploitation of children;
impersonate someone, create fake profiles, or mislead people about who you are;
share other people's private information without permission;
infringe anyone's intellectual property or other rights;
use bots, scripts or scraping, abuse free credits or promotions, or interfere with POVL's security or operation;
copy, reverse engineer or resell POVL, except where the law expressly allows it.

7. Reports, blocking and moderation

You can report content and users from within the app. We don't tell the reported user who reported them.
You can block a friend. Blocking ends the friendship, withdraws pending analyses between you and stops new friend requests between you.
We have zero tolerance for objectionable content and abusive users. We aim to review reports within 24 hours. We may remove content, limit features, or suspend or close accounts that break these Terms.

8. Credits

Some features use credits. You can buy credit packs in the app, and we may give free credits, for example a welcome bonus, weekly credits or streak rewards. Free credits and their rules can change or end at any time.
Credits are a licence to use features in POVL. They have no cash value, cannot be exchanged for money, and cannot be transferred to another account.
Purchased credits don't expire while your account exists. They are lost when you delete your account.
Credits are added to your account as soon as Apple confirms the purchase. Credits you have used cannot be returned, except as required by law. If a paid action fails because of a fault on our side, we return the credits used for it.
Prices are set in the App Store for your country and shown before you buy. Price changes don't affect credits you already have.

9. POVL Pro subscriptions

POVL Pro is offered as weekly, monthly and yearly auto-renewing subscriptions. Pro unlocks the features described on the purchase screen when you subscribe. The price and length of each plan are shown before you buy.
Payment: payment is charged to your Apple Account when you confirm the purchase.
Auto-renewal: a subscription renews automatically for the same length at the then-current price unless you cancel it at least 24 hours before the end of the current period. Your Apple Account is charged for the renewal within the 24 hours before the period ends.
Cancelling: you can cancel at any time in iPhone Settings → your name → Subscriptions. Cancelling stops the next renewal; Pro stays active until the end of the period you paid for. We cannot cancel subscriptions for you.
Free trials and introductory offers: available only when the App Store offers them to you. Apple shows the offer, its length and your eligibility on the purchase sheet. Unless you cancel at least 24 hours before a trial ends, the subscription continues at the regular price. Any unused part of a free trial ends when you buy a subscription.
Price changes: Apple tells you about price increases in advance and, where required, asks for your consent.
Deleting your account does not cancel your subscription. Cancel it in Settings first.
You can restore purchases on another device with the same Apple Account using Restore Purchases on the purchase screen.

10. Payments, cancellation and refunds

All purchases are processed by Apple under Apple's terms. We never receive your payment details.
Refunds are handled by Apple under its refund policies. You can request one at reportaproblem.apple.com. We cannot issue refunds ourselves.
If Apple refunds a purchase, the related credits or Pro access are removed from your account.
Nothing in these Terms limits rights you have under mandatory consumer law. If you are a consumer in the EU, EEA or UK, you may have a statutory right to withdraw from a purchase of digital content within 14 days; for content supplied immediately, that right can end once supply begins, where the law allows. Apple's terms may give you further cancellation or refund rights. If you are a consumer in Türkiye, the right of withdrawal does not apply to services performed instantly in electronic form or to intangible goods delivered instantly (Distance Contracts Regulation, Art. 15(1)(ğ)).

11. Our rights in POVL

POVL, including its design, texts, graphics, questions, algorithms and code, belongs to Barış Altın and is protected by intellectual property laws. We give you a personal, non-exclusive, non-transferable, revocable licence to use the POVL app on Apple devices you own or control, for your own non-commercial use, in line with these Terms and the App Store rules.

12. Third-party services

POVL relies on services such as Apple (App Store, Sign in with Apple), Google (Sign in with Google, connectivity check), Supabase, Adapty, Expo, Cloudflare and DiceBear (placeholder avatars). Their own terms apply to your use of their services. Links to other websites are for convenience; we are not responsible for their content.

13. Changes to POVL and ending this agreement

You can stop using POVL and delete your account at any time.
We may suspend or close an account that seriously or repeatedly breaks these Terms or the law, or when needed to protect other people or POVL. Where appropriate, we will tell you why and how to contact us. If we close your account because you broke these Terms, unused credits are lost, to the extent the law allows.
If we decide to stop offering POVL, we will give you reasonable advance notice in the app.

14. Disclaimers

We work hard to keep POVL available and accurate, but we provide it "as is" and "as available". To the extent the law allows, we don't promise that POVL will be uninterrupted or error-free or that reports will be accurate or suitable for any purpose. This does not affect any guarantees you have under consumer law that cannot be excluded.

15. Liability

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, for intentional misconduct or gross negligence, or for anything else that cannot be limited by law.
Subject to that, we are not liable for indirect or consequential losses such as lost profits, lost data or damage to reputation, and our total liability to you is limited to the amount you paid for POVL in the 12 months before the claim.
If you are a consumer in the EU, EEA or UK, the limits in the previous point don't apply to you. Instead, we are responsible for loss you suffer that is a foreseeable result of our breach of these Terms or our failure to use reasonable care, and not for loss that was not foreseeable.

16. Indemnity

To the extent the law allows, you agree to compensate us for claims by third parties that arise because you broke these Terms or the law, for example by posting unlawful content about someone. This does not apply where the claim is our fault.

17. Governing law and disputes

These Terms are governed by the laws of the Republic of Türkiye, and the courts and enforcement offices of Istanbul (Çağlayan) have jurisdiction.
If you are a consumer, this choice does not take away the protection of the mandatory laws of the country where you live, and you may also bring a claim in the courts of that country.
Consumers in Türkiye may apply to the consumer arbitration committee or consumer court in their place of residence, within the limits of Consumer Protection Law No. 6502.
Before going to court, please write to hello@povl.app. Most problems can be solved quickly.

18. Apple App Store terms

If you downloaded POVL from the Apple App Store:

These Terms are between you and Barış Altın, not Apple. We, not Apple, are responsible for POVL and its content.
Your licence is limited to using POVL on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
Apple has no obligation to provide any maintenance or support for POVL.
If POVL fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price of the app (if any). To the maximum extent permitted by law, Apple has no other warranty obligation for POVL.
We, not Apple, are responsible for handling any claims relating to POVL or your use of it, including product liability claims, claims that POVL fails to meet legal or regulatory requirements, and consumer protection or privacy claims.
If a third party claims that POVL infringes their intellectual property rights, we, not Apple, are responsible for investigating, defending, settling and discharging the claim.
You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

19. Changes to these Terms

We may update these Terms, for example when POVL or the law changes. The date at the top shows the latest version. If a change is material, we will tell you in the app or on this website before it takes effect. If you continue to use POVL after that, the new Terms apply; if you don't agree, you can stop using POVL and delete your account. Changes don't affect a subscription period you have already paid for.

20. General

If any part of these Terms is invalid, the rest stays in effect.
If we don't enforce a right straight away, we don't give it up.
You may not transfer your rights under these Terms. We may transfer them to someone who takes over POVL, provided your rights are not reduced.
These Terms and the Privacy Policy are the whole agreement between you and us about POVL.
These Terms are available in English and Turkish. If the versions differ, the Turkish version applies to users who use POVL in Turkish, and the English version applies to everyone else.
